Is the Rumor That the Manufacturer of Berkey Water Filters is Going Out of Business and Closing its Doors True?

No, we are NOT going out of business! The company that owns Berkey water filters is not going out of business, either.

New Millennium Concepts Ltd., the company that manufactures Berkey water filter systems, has been in business for more than 25 years.  We have been an authorized Berkey dealer for over 16 years, supplying consumers across the country with state-of-the-art water filtration systems, and will continue to offer Berkey products for many years to come. As a trusted distributor/dealer of Berkey products, we will continue to supply Berkey water filter systems and provide our customers with the high level of service and after-sales support they are accustomed to. 

What is Going on with Berkey Water Filters?

At the end of 2022, the US Environmental Protection Agency (EPA), without undertaking any administrative process, used its regulatory authority to classify the Berkey water filtration filters, a trusted leader in gravity fed water filtration systems and one of the most popular water filters in the US, as pesticides under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) claiming that Black Berkey filtering elements contain silver and are a pesticide device since silver is antimicrobial. With this new Pesticide classification, Berkey products would be required to come with warning labels to this effect.

It's important to note that silver is not considered a pesticide under FIFRA, and has not been regulated by the EPA as such before this. As silver is incorporated as a component of thousands of water filters and other consumer products, if it is regulated as a pesticide, manufacturers of these products would also be forced to register their products as pesticides and attach warning labels to them.

Has Berkey Sued the EPA?

In August 2023, the manufacturers of Berkey Water Filtration Systems filed a lawsuit against the EPA to prevent them from classifying Berkey filters as a pesticide, in what is considered by some, including Rep. Matt Gaetz (R-FL) to be an abuse of the agency's power in an attempt to put the company out of business.

Despite the Rumors, Berkey Water Systems is Not Going Out of Business

On December 19, 2023, New Millennium Concepts, the manufacturer of Berkey filters, released a statement in response to a dealership closing their doors. The notice below was just released by the manufacturer and owner of Berkey.

It is with deep sorrow that we learn that our longtime distributor BerkeyFilters.com is closing its doors. As you may know, New Millennium Concepts, Ltd. is currently suing the EPA for re-interpreting their rules for the express purpose of classifying Berkey® products alone as Pesticides. The EPA has not utilized this new re-interpretation to stop the sale of any other outdoor water filter, just Berkey® alone. We have been informed that the real issue is that because of COVID-19, the EPA does not like the fact that Berkey® filters are capable of removing viruses from your water.

BerkeyFilters.com was the first dealer to receive a Stop-Sale Order, and we together worked with the EPA to rectify the situation. However, after working with the EPA for about eight months, it became apparent that the EPA would accept nothing less than the bankruptcy of New Millennium, its dealers, and more importantly preventing you the public from being self-sufficient in terms of cleaning difficult-to-remove contaminants from your drinking water. Accordingly, we sued the EPA and the case is now in the Appeals Court. We are now in appeal because, amazingly, the district court ruled that New Millennium had not been harmed by the EPA issuing Stop-Sale orders to its dealers, its manufacturing facility and other vendors, and therefore had no standing in that court. Unfortunately, over the course of the past year, the folks at BerkeyFilters.com have fallen victim to this overreach by the EPA. We wish them the best.

Having said that, we want to clear up any confusion between New Millennium Concepts, Ltd. (NMCL) the manufacturer and brand owner of Berkey® Water Systems, and Berkeyfilters.com. Berkeyfilters.com is no longer an authorized Berkey® dealer, and again, is closing its doors.

We at New Millennium Concepts, Ltd. assure you that the Berkey® brand is alive and well and is still the trusted leader in gravity-fed water filtration systems and products. To be clear: New Millennium is not closing its doors and is actively engaged in fighting the EPA's overreach and its attempt to control and prevent the public from purifying their drinking water.

Why are Berkey Filters Out of Stock?

If you are wondering why are Berkey filters out of stock at many authorized dealers, here is the answer. The EPA has issued Berkey water filters with a stop-sale order, requiring all Berkey water filters to carry pesticide warning labels before being sold to customers. As the manufacturers of Berkey systems are in the process of contesting this, they will not be producing some of the Berkey products until the legal action against the EPA is concluded. Stock you do see online stock is that which was already produced prior to the stop sale.

When Will Berkey Water Filters Be Back in Stock in the USA?

Berkey filters will be back in stock once legal action with the EPA has concluded. The outcome of the court case will determine whether Berkey filters will be forced to carry warning labels in the future, or if an injunction is granted so that the filters can resume current production as prior to the stop sale. However, while the manufacturers navigate this difficult transition, some authorized Berkey distributors still have a limited stock of Berkey systems and replacement Black Berkey filter elements available.

Why are some Berkey Water Filters dealers closing?

Some Berkey dealers were targeted and have been issued with a Stop-Sale Order by the EPA and cannot continue selling Berkey products unless they contain the newly required warning label. Understandably, this is very damaging to any small business, as most small businesses cannot pay their overheads and remain in business if they cannot sell their products. 

Who Else is Probing the EPA?

Besides the legal action being taken by New Millennium Concepts requesting a temporary restraining order and preliminary injunction against the EPA to prevent it from enforcing the pesticide registration requirement on Berkey products, US Congressman Matt Gates (R-Fl) is also probing the EPA's new ruling. Congressman Gates recently submitted an open letter to EPA Administrator Regan requesting supporting documents to substantiate these new regulatory requirements, which not only discriminate against Berkey, but could harm the very public whose safety they are supposed to protect. As we navigate this difficult transition and its associated challenges, we are deeply grateful for the trust shown to us over the many years that we have been providing quality Berkey filtration systems and Black Berkey filtering products. We hope to maintain this trust and loyalty as we will continue to serve our clients in the future. Be confident that filters and systems will become more readily available in the future, however that exact timeline is not yet known, but we are hopeful it’s in the very near term.

    A pesticide warning will not stop me from purchasing a Berkey. But not having replacement filters will . You all have established a strong enough reputation within the water purifying community to ward off any frivolous lawsuits against you all. Hopefully this will be corrected soon.

    Hi Ali - It's not a lawsuit against us but a stop sale on the filters. So, we are suing to reverse the stop sale so we can provide these black berkey filters to our customers. We made many concessions to the EPA early in the process to try to appease their demands but the goal posts were moved every time. So, it's not as simple as placing a pesticide label on the filters and everything is copecetic. We're hoping negotiations with the new EPA admin will result in some positive outcomes. Thanks Dan

    Hello, how interesting that I just found out about this lawsuit, sorry to hear. I bought a Berkey travel unit (perhaps from you?) about 2 or 3 yrs ago, but it's still unpacked in storage in a pile of boxes; now I have to find it. I never used it, and want to set it up now. **Do the filters stay intact if they're on the shelf all that time, or do they go bad? **Do you see me in your files?     Having a problem with the wingnuts for the black filters. The plastic they're made from seems to be softer and prone to cross threading, which means that you can't get a waterproof seal when you reinstall the black filters after cleaning.

    Hi Chris - There are none available currently, and we do not have an exact timeline yet. In the meantime, we are offering the comparable ultra sterasyl ceramic filters.     Every one is worried that berky don't have a NFS cert. I don't care either way I just want to know that you have Truth and Integrity and have produced and tested and Made these filters work to remove toxins of all sorts for people to have good clean water to not only enjoy but to lead healthier lives . Truth and Transparency filters out unwanted dirty particles . Be open with your Lab results test it against everything keep improving it until no other filter can even come close to its performance. The end result should be the cleanest clearest safest cool glass of water known to Man. What else is there that's more important for daily life for wellbeing than the purest water that can be obtained by taking water holding it loving it and then patiently persuading it to follow a path where when it reaches the other side has been reborn it is new and sparkles as if it were diamonds .

    If any government agency is attempting to close a business or spread rumors about the false information then they’re definitely a company that we the people must support. The government agencies and their puppets have failed years after years and I don’t trust them whatsoever. I love my Berkey products and will keep using them no matter what is said. #KeepAmericaGreatAgain in all areas!

    Berkey claimed to filter the water safely for a sinus rinse when I bought it, prior to 2022. It was a big selling point with me. Is my Berkey filtered water safe for my daily sinus rinses without boiling or am I putting my life in danger?

    This is bureaucracy at its finest! This is so sad. I hope that Berkey wins their appeal. I have a question. We bought the Berkey water system and 2 black filters two years ago. There are only two people who drink the filtered water. About how long do the black filters last?

    I have just chanced upon this article/conversation about the troubles that Berkey USA is going through. I live in England and have two Berkeys for my guesthouse and they are just brilliant, we have lots of issues in the UK with naturally hard water and overuse of Chloride so I am very grateful we have these water filters. As a stopgap solution until the EPA is made to see sense, Is there anyway that your US customers could order their filters from England or would that just be too expensive? Can they order them from Canada? Just too annoying if your competitors move in and steal your customers because they can't get replacement filters... :-( Caroline

In my line of work -construction/building we constantly fight & WIN govt overreach.     Hello, I’m really confused. I just bought The Big Berkey. It arrived a few days ago with the filters included. I ordered it from a site called MYBERKEY. Are you one and the same? Or did I not order a real Berkey, and just a knock off? …just that after reading all of these comments about the EPA dispute and how no one can order a Berkey filtering system or the filters, not sure how I was able to receive one???     The fact that the Environmental "Protection" Agency is going after Berkey Filters simply demonstrates that the agency has been given too much power, and as we know, too much power corrupts. Perhaps the EPA should be put through a corruption filter which would remove certain individuals. Could you guys design one? This could be useful for other agencies as well! I'm glad to hear that New Millennium Concepts is fighting this. Besides many of the other water filter products, silver is also used in several health products, and if this is allowed to go down, then they're next. We could all stand to lose a lot more than our favorite water filter. I would also like to know how we could help.

    We've had our Berkey system since 2021 and still use the original filters. We clean the filters and system every 3 months and do the red dye test. We LOVE the system (just hubby and me plus 2 dogs). That said, referencing an antigovernment, Matt Gaetz-supporting, "Covid is a hoax" mentality is very off-putting. All I care about for my water filter system: 1) does it work (data supported), 2) is the system going to last. Hopefully there is a resolution soon.

    So Kathy, if you LOVE your Berkey system, as so many of us do, and you disagree with Matt Gaetz and the anti-governement comment...why don't you please explain to the rest of us why the United States government would go out of their way to use taxpayer money to force a stop sale on Berkey filters? Why did the timing coincide with the Covid-19 pandemic? Go ahead Kathy...we are very interested in your explanation.

    I agree with you completely and those who say covid is a hoax should tell that to the man whose daughter died last week and to the families of the 119,165 lost the first year. Tell it to the doctors, nurses and ministers. Like you, I just want a water filter that works; I can do without the Qanon conspiracy tabs. I use colloidal silver & it's well known that silver has microbial properties. I am curious about the specifics of the EPA ruling, though, and will research further. Meanwhile, my daughter bought a house on a well and needs a Berkey.

    I'm sorry to hear this is going on. Our government never fails in overstepping their boundaries and abusing their appointed power. It makes no sense that they can literally dump chlorine, bromine, and fluoride into our water and call it "safe" to drink, but then turn around and say that the limited amount of silver in the filters are a pesticide and unsafe. I know you can't speak to the details of the case, but just know lots of people believe in your product and are supporting you in spirit, if that helps!

    I’m so glad I realized what was about to happen and stocked up on filters at the beginning of this. I hope it’s resolved soon. Just bought a new system for my daughter. I taught her how to clean the filters and test them with red dye to keep them going as long as possible. You know you’re making real change when this government comes after you. Many of us have realized that they aren’t there to actually protect the public.

    First, Matt’s last name is not Gates. Second, people should be very concerned that the US Government does not want us to be able to continue removing viruses from our municipal water supply after successfully doing so for over 25 years. The only reason I can come up with is not a good look for our masters. Thank goodness I’ve been paying attention and bought my spare filters right after the lawsuit was filed. The people buying alternative filters are going to be mighty dissapointed…

    I bought sets of Black Berkey Filters with fluoride filters in about 2010, and am ready to replenish my supplies. I have heard and read many comments pro and con about the Berkey filters in the last year or two. One reports said the filters were no longer functioning to the advrtised standards, another that some companies have begun to manufacture inefficient knock-offs and marketing them as Black Berkeys, and the ridiculous stance that the EPA has taken. I also noted that the filtration test results you have published on your website are now well over 10 years old. Do you, particularly in view of the bad pess from knock-off filters, have plans to test your current supply of Black Berkey filters with another nationally certified lab? (I thought you might appreciate knowing that a top rated food chemistry lab recently did extensive testing with an array of water filters to determine which of them would filter out cesium, a heavy metal commonly assiciated with nuclear fall-out from fission nuclear reactions. He has stated that he was having difficulty locating an offical Berkey water filter distributor, and was hesitant to include the Berkey results, which were in the highest percentile of effectiveness with filtering cesium, for permission to include his Berkey results in his offical announcement of his findings. He further commented that he had until recently included Berkey filters in his sales catalog, abut he could not longer finda supplier. His name is Mike Adams. He can be reached on line via the Health Ranger Store, where he markets products that pass his exemplary stringent standards for food and chemical purity.) Lastly, I have heard of a U.S. legislator named Matt Gaetz from a Western state. who has become quite a champion of businesses and professionals maligned by federal eniities.     Hi Sandy - The filter formula has not changed since inception, so there is no plans to repeat tests, but there is plans for additional testing. All of that is on pause right now while litigation is ongoing. We hope this comes to an end soon because between the knockoffs and tight supplies, we know it's tough for our consumers.     Kept us alive: When we found a 6mo Maltipoo, the vet said to put her down, her organs weren't working properly. We disagreed & never saw that vet again. Holistic Vet & Traditional Chinese Veterinary Medicine, supplements, food therapy, AND water from our Black Berkey gave us 15 yrs with her. The best 15 yrs of our life. Couldn't have done it without our Berkey. Shame on the EPA. What can we do to help? Please advise.

    Why not just carry the warning label with an extra explanation from the company AND keep manufacturing and selling? Berkey already has a huge loyal base and reputation. Everybody will know the dumb EPA label is just a formality. Their customers are being punished.

    Hi Susan - The filters would need to be registered as pesticides if the company were to go down this route, and would have large implications across many industries. That is always a potential future option, but nothing can change while litigation is ongoing. Thanks Dan

    I'm confused. I purchased a Berkey system and it has performed so well that other family members want to buy one. I went on the berkeyfilters.com site to send them a link to purchase a Berkey system and it said Berkey is going out of business. I was shocked and saddened. Now you're saying that's not right and berkeyfilters.com is not an authorized dealer? Who IS an authorized dealer? I looked on this site and can't find any one. Please help!

    We all need to stand up against this! The EPA is not about protecting the people. They know the Berkey works! It works too well! They want it stopped. Look up Moses West, he invented a clean water system and then mysteriously died in a VA hospital. It turned condensation into pure clean drinking water. He was a good man, healthy and happy.It worked too well too. Do some research. It’s time to take a stand!

    I can’t believe this. I came on here to figure out why it’s impossible to get filters and I finally read the true story of what has happened to Berkey. All I have to say is, wow they are even messing with our water anything to keep us sick and poisoned with toxins. This makes my blood boil. Can we all help by writing to the EPA (another overreaching gov agency trying to control us)? When can we buy filters? I am so sorry you all are dealing with this. May God help us in this crazy world!

    I love my Berkey filter and do not care about what kind of label you have to place on it. I am happy to buy replacement cartridges with the pesticide label if that’s what you need to do to keep selling while you fight this.

    Hi, is there a date set on when the appeals court will have their final say on your lawsuit/appeal? Do you think it will be this year that they will make a decision? We are dragging our feet in possibly buying a new water filtering system, but keep putting it off bc we want our Berkey... :(

    I just heard about this. The same EPA who won't say anything bad about glyphosate that gives cancer to so many people. This is ridiculous. I've put our name on the list for when we can buy the real Berkey filters again. We live in a heavy pesticide use area, and i rely on Berkey. I don't want substitutes.

    I'm glad to hear that Berkey is not going out of business. Does the Supreme Court Chevron decision help expedite the process? I thought it would be a no brainer since the EPA is clearly overreaching here

    Hi Lennie - The systems still are coming with the original black berkey filters. While thee lawsuit is ongoing, we are still permitted to sell the black berkey filters with the systems as long as they were produced before the EPA stop order. We sold out of the replacement black berkey filters in April as they moved much faster, as you can imagine. Thanks Dan

    If the company doesn’t get anywhere in court, will you continue to sell the filters and systems using this ridiculous label? Understanding it’s not ideal, and wondering what can be done with an expensive water filter, that I can’t purchase replacement parts for.

    Hi Lindsay - Yes, there are alternative plans in the wings depending on the court ruling. The company plans on staying in business and meeting our customers needs for a looong time. We are just stuck in a tough spot temporarily.
